The Central Board of Secondary Examination (CBSE) has informed the Supreme Court that the decision on the conduct of this year's Board examination will be taken by tomorrow evening. 

The Apex Court has further granted the Indian Certificate of Secondary Education (ICSE) the liberty to follow the decision taken by CBSE or the Centre accordingly, albeit with slight modifications.

A Bench of Justices AM Khanwilkar, Dinesh Maheshwari and Sanjiv Khanna heard the plea, filed by parents of students of 12th standard, seeking the cancellation of the Board examinations which are to take place in July.

The plea, filed by Advocate Rishi Malhotra on behalf of the parents of students scheduled to appear for the exams, challenged the decision of the authority to conduct the remaining examinations from July 1 to July 15 in the midst of the COVID-19 pandemic, stating that the same is arbitrary and in violation of Article 14 of the Constitution of India.

On 17th June, the Court had directed CBSE to hold consultation and take a decision by the following week regarding the conduct of the remaining Board exam papers and to examine whether marks could allotted on the basis of internal assessment.

Today, Solicitor-General Tushar Mehta, appearing for Ministry of Human Resource Development and CBSE, submitted to the Bench that the decision-making process was in an advanced stage and the Bench would be apprised of the formal decision by tomorrow evening.

Accordingly, the Bench deferred the hearing to June 25 at 2 PM so that the SG could get appropriate time to respond.

The Bench further noted that the matter concerning ICSE exams was also in limbo and instructed the SG to respond to the same.

Senior Advocate Jaideep Gupta, appearing on behalf of ICSE, informed the Bench that they were waiting for the orders to be passed by CBSE before taking any decision as ICSE was an independent board.

In response to this submission, Justice Khanwilkar directed ICSE to follow the decision of CBSE.

"No reason for ICSE to not follow suit, considering the unprecedented situation, of course with slight modifications. The decision by CBSE will be delved upon and be an informed decision."

Matter has accordingly been adjourned to June 25.
