Children Of Parents Included In Assam NRC Will Not Be Sent To Detention Centres : AG Tells SC [Read Order]

The Attorney General of India K K Venugopal on Monday assured the Supreme Court that children of persons included in Assam NRC will not be sent to detention centres while the Court is considering the application seeking protection of such children.

The AG made this submission before a bench of CJI SA Bobde, Justices Surya Kant and B R Gavai in an application which pointed out that many children were excluded from the Assam NRC despite their parents being included in the list. The petitioners sought protection for such children from coercive measures.

The submission made by the AG, as recorded in the order of the Supreme Court, is as follows :

"Mr. K.K. Venugopal, learned Attorney General for India, states that the children of parents who have been given citizenship through NRC, will not be separated from their parents and sent to detention centre in Assam pending decision of this application".

Assam NRC is a register containing names of persons deemed as genuine citizens in terms of Assam Accord. To be included in the Assam NRC, a person of Indian origin has to prove domicile or legacy tracing back the cut-off date of March 24, 1971.

On August 12, the SC had ordered that children born after December 3, 2004 are not eligible to be included in the NRC list, if any of the parent is a DV (Doubtful Voter), DF (Declared Foreigner) or PFT (persons with cases pending at Foreigners Tribunals).

In another application, the Court has directed the new Assam NRC coordinator Hitesh Dev Sarma to explain some of his 'communal' Facebook posts in relation to NRC.
