[Central Vista Project] "Who Is The Owner Of Parliament Building?" Read Courtroom Exchange During SG Tushar Mehta's Arguments
The matter has now resumed.
Matter will now resume post lunch.
SG: For deciding that a new Parliament is needed, we don't need a separate study. If I feel that the house I am living in is not acceptable, do I really need to invite an expert to determine that ?
Bench: Should we say that It was a nuanced policy decision by the government; a vision document for the entire area to separate this from other projects because of its importance?
“Off-hand, can you tell us what is the net effect if you separate the Parliament project from CV?”
SG: It is not to escape the scrutiny at all. Stringent conditions have been imposed fo mitigation. Look at the project of this nature
Mehta now presents an Application seeking environmental clearance.
“Why EIA is taking place for C-Sec, please see. It is wrong to assume that anybody can come in and object during this EIA proceedings. It is only for the neighbours to come and object”.
Bench: This note that you’ve submitted does not include what you intend to do during the construction activities. There is bound to be environmental issues.
SG: I’ll revise it. Clearance and directions have been given.
Mehta: The government is coming up with an iconic project. We will of course take care and not violate laws. We have a responsibility. I will read the mitigating measures now.
Mehta: If the Petitioner’s concern is that the environment should not be harmed, that will be taken care of, not just after, but also during the project.
Mehta: Parliament is one consolidated unit and it must be developed in that manner. See the EC for Parliament and the procedure followed by stakeholders and the authorities taking the decision.
