The Supreme Court on Friday adjourned to 6th September the plea filed seeking directions to CBSE to declare results & change date sheet of Class XII Private, Patrachar & 2nd Compartment Students to ensure that proposed exams will not clash with other exams.

A Bench comprising Justice AM Khanwilkar, Justice Hrishikesh Roy and Justice CT Ravikumar has asked the petitioners' counsel to serve an advanced copy of the petition to the All India Council For Technical Education, a respondent in the present matter.

The bench also indicated that the relief of declaration of results of Class XII Private Patrachar/2nd Compartment Students being sought by the petitioner cannot be granted as there is already a commitment by CBSE that results will be declared by 30th September.

"The relief can't be granted as there is already an assurance by CBSE that results will be declared", Justice Khanwilkar orally said.


"The problem is till then, All India Council For Technical Education is already taking admissions." Petitioner Counsel informed the Court.

The Bench, therefore, recorded that, "Petitioner to take steps to serve advanced copy to All India Council For Technical Education. List on Monday".

During the hearing, Advocate Anjaneya Mishra appearing for the petitioner urged the Court that a direction may be issued to the UGC asking it to direct colleges to not take admissions unless results were declared.

The Bench asked Advocate Apoorv Kurup appearing for University Grants Commission if a General direction can be given to all Institutes that admission process be commenced only after all results are out.

Advocate Apoorv Kurup informed the court, "In July 2021 we had issued an academic calendar, the completion of admission is upto 30th September. The last date of filling vacancies is till end of October. If CBSE gives a firm date, there is enough time"

Advocate Rupesh Kumar appearing for CBSE informed the court that as far as CBSE is concerned, the last date for conducting exam is 16th September and results will be declared by 30th Sept. He added that in another writ petition heard by the Apex Court regarding cancellation of class XII exams, CBSE's schedule was approved by the court.

" There are 2 matters before us. First writ petition is for declaring results of Class 12 private, patrachar, 2nd compartment students. Are those exams conducted?" the Bench asked

" They are halfway conducted. 8 exams have been conducted and remaining 9 are left". Mr Kumar said.

"Let him (counsel for AICTE) appear with instructions. Time is as it is running against all of you." the Bench orally observed.

The bench then asked the counsel to serve the AICTE's counsel the copy and posted the matter to September 6.
