Singhvi: Please say expeditiously
J Khanna: Goes without saying. Parties may file addl note/documents within 1 week
J Khanna: Arguments heard. Judgment reserved
Notwithstanding the same, and without prejudice to rights and contentions, appellant can move the trial court for grant of bail in accordance with law
SG Mehta clarifies the issue regarding his written submissions
Bench perusing the case files furnished
J Khanna: We want any of the statements after Manish Sisodia and before Kejriwal's arrest. And we want to look at the files
Singhvi: S.70 issue may be left open. Judgment in hurry may have wide implications
Singhvi: Leave aside Sarath Reddy, no other statement mentioned in grounds of arrest. Without prejudice, this is a predicate offense. Kejriwal not accused in predicate offense till date of arrest.
J Khanna: You campaign in Goa and stayed at that hotel?
Singhvi: NCT paid bills. 1 lakh or something...
J Khanna: Not the hawala operators...the hawala operator has not paid!
Singhvi: Sarath Reddy purchased Electoral Bonds. On back pain, given bail. He is trustworthy enough to put me behind bars? Now my association with Vijay Nair
Singhvi: They have a case against Vijay Nair. They rope me in saying he was my "aide"
Singhvi: He is an IT consultant. He used guestroom frequently. Not a statement recorded about excise policy. ED is presuming Vijay Nair reported to me. Grounds of arrest are 'close associate'
J Khanna: Can't go into all this
Singhvi: Over 1.5 years, they conducted investigation. No action against Kejriwal. There was no necessity to arrest based on material that was there with ED in July-August 2023
Singhvi: This is to create doubt at the last minute. He is not being fair! He says this at 4:30 on Friday
SG replies
Singhvi: Very convenient. It seems from March till today, they were suppressing evidence
J Khanna: What is the material after Sisodia's judgment
ASG: I have put in written submissions. Nowwe have found chats between Kejriwal and hawala operators
Singhvi: This is for Court or media? Was he suppressing this till today?
