On Wednesday, BJP leader Subramanian Swamy moved the Supreme Court against a recent plea to examine the alleged amassing of disproportionate assets by Enforcement Directorate (ED) officer Rajeshwar Singh.
Singh is leading the investigation in the 2G spectrum scam, including the 2006 Aircel-Maxis matter which involves former Finance Minister P Chidambaram and his son Karthi Chidambaram.
A vacation bench of Justice AK Goel and Justice Ashok Bhushan had, on June 5, signified acquiescence to entertain the PIL filed by Rajneesh Kapur.
Making a mention before a bench of Justice Abdul Nazeer and Justice Indu Malhotra, Swamy on Wednesday submitted, “On June 5, a fresh writ petition has been filed arising out of the Aircel Maxis matter where I have been the principal petitioner...this court has (on March 12) directed all investigation to be completed within 6 months...the claim of disproportionate assets have been raised against investigator in this petition...the purpose is only to delay the matter for the benefit of powerful people...this has happened before also...”
He pressed that the concerns raised by him required immediate consideration. However, Justice Nazeer remarked that Swamy may make a mention before the next vacation bench: “My sister has some reservations...please mention again on Monday...”
Earlier, on November 1, 2017, another bench of Justice J Chelameswar and Justice Nazeer had restrained the Centre from initiating any action against Singh based on anonymous complaints against him.
His counsel Gopal Sankaranarayanan had contended that due to his clean record and honesty, Singh has been entrusted with high-profile cases, including the 2G and Sahara cases.
Subsequent to the filing of the said PIL, on June 6, Swamy made it clear on his Twitter handle an intention to “retaliate”. He wrote: “Is there a BJP/UPA/Politicians / Bureaucrats/Lawyers secret brotherhood to protect each other? My research says yes there is, and that has so far delayed BJP's anti corruption campaign. Namo must strike them down for which he can count on my help...To save PC, bureaucrats especially 4, in Namo govt who are complicit or honey trapped by PC, are targeting Dr. Rajeshwar Singh of ED. The latest PIL before SC Vacation Bench is for me a declaration of war against anti-corrupt warriors. I will retaliate.”
