The first phase will be conducted on 1st May and Second phase will be on 24th July. The entire results will be declared on 17th August. The admission Procedure will be completed on 30th September.
From the order;
“AIPMT 2016 to be held on 1st May, 2016 shall be phase I of NEET.
Phase II of NEET for the left out candidates shall be held on 24th July, 2016 by inviting applications with fee.
Combined result of both the Tests shall be declared on 17th August, 2016.
CBSE will provide All India Rank. Admitting Authorities will invite applications for Counselling and merit list shall be drawn based on All India Rank.
All associated with conduct of Exam including Central Govt., State Govt., institutions, Police etc. will extend all necessary support to CBSE and permit security measures like use of electronic and communication devices Jammers etc. for timely and fair conduct of the NEET.
Any difficulty with regard to implementation of orders of this Court the stake holders may approach this Hon'ble Court.”
"In view of the submissions made on behalf of the respondents, we record that NEET shall be held as stated by the respondents. We further clarify that notwithstanding any order passed by any Court earlier with regard to not holding NEET, this order shall operate. Therefore, no further order is required to be passed at this stage",said the Bench
Earlier Supreme Court of India has reserved its order on whether the National Eligibility Cum Entrance Test (NEET) will be conducted this year or not. The CBSE and Medical Council of India (MCI) stated before the Court that they are ready to conduct the examination this year. They have submitted the fresh schedule for the examination, as directed by the Court Yesterday. But the Private Medical Colleges strongly objected the examination for this academic year. Some State Governments also objected the Common Examination.
According to the ANI , CBSE has proposed that the examination can be conducted in two phases. 6.5 Lakh students can appear in the first phase and 2.5 lakh students can appear in the Second phase. The first phase can be conducted on 1st May and Second phase can be on 24th July. The entire results can be declared on 17th August. The admission Procedure can be completed on 30th September.
The Petition was filed by Sankalp Charitable Trust for a direction to hold National Eligibility Cum Entrance Test (NEET) in terms of Regulation of Medical Council of India (MCI) for academic year 2016-17 for admission to MBBS, BDS and like Courses of medical colleges throughout the country. Prayer was also made to stay the exam to be held for 15% by CBSE on 1st May.
Yesterday the case was taken up on oral mentioning by Justice Dave, Justice Goyal and Justice Shiva Kirti Singh at 12.30. Statements of counsel of CBSE, UOI and MCI were recorded in the order that NEET will be held for current academic year for admission to medical and dental colleges in India. Court directed to place the fresh schedule for holding of common entrance exam before the Court Today.
A Constitution Bench of the Supreme Court had allowed the Review Petition of in Medical Council of India Vs. CMC Vellore [Review Petition (C)Nos.2159-2268 of 2013 and Review Petition (C) Nos.2048-2157 of 2013] vide its order dated 11.04.2016 and thereby the Regulation framed by MCI with prior permission of the Central Govt. for holding of the Common Entrance Test for admission to Medical Courses in India both in private and Government Medical Colleges stand revived. In view of the judgment and orders passed by Constitution Bench, path for holding of Common Entrance Examination (NEET) for admission stand cleared and there is no impediment in holding Common Entrance Test for admission to Medical Colleges for current academic year, i.e. 2016-17, stated the Petitioner. It is also submitted that the last date for admission in Medical Colleges as provided in the regulation of Medical Council of India is on 30th September. Therefore, there is a sufficient time for holding Common Entrance Test for current academic year by the MCI and CBSE and make admissions before the said date.
