The Delhi High Court has sent out a communication to the Delhi police commissioner asking him not to post same naib court in a court or with a judicial officer for long duration for it reflects poorly on the credibility of the justice delivery system.
In a letter through Registrar General Dinesh Kumar Sharma Acting Chief Justice Gita Mittal has asked Amulya Patnaik to ensure that a naib court is not posted in the same court/ same court complex and with the same judicial officer for more than three years.
The Acting Chief Justice in her letter, triggered by a number of complaints in this regard, said posting same naib court in one court for long duration is impressive of a “nexus” which is not conducive for the credibility of a robust justice delivery system.
A naib court is a police personnel deployed in the court by the DCP of every district. They act as link between the court and the police station concerned.
The letter to Mr Patnaik read, “the high court of Delhi is in receipt of lot of complaints that there is unhealthy practice of continuous posting of particular naib courts in the same courts or with the same judicial officer for long durations.
“Such continuous and long postings leave an impression of nexus which is not conducive for the credibility and functioning of robust justice delivery system. In order to inspire confidence of the litigants and the lawyers, the Acting Chief Justice has been pleased to direct that a naib court may not be posted in the same court/ same court complex and with the same judicial officer for more than one tenure. The duration of the tenure should not exceed three years in any circumstance”.
