The Madhya Pradesh High Court has rejected the plea of some villagers of Chakaldi in Sehore district seeking direction to the state government not to demolish their houses and allocate the land on lease on which the houses are constructed.
The petitioners stated that the lease may be granted in view of the policy announced by the Chief Minister on allocation of patta (a small piece of land) to the landless and the houses may not be demolished.
Also the petitioner contended that the landless persons have constructed their house on the land of survey No.187 in area of 5.472 hectares because the gram panchayat permitted them to construct the house.
The petitioners sought direction to the respondents to implement the policy of grant of patta to landless persons who are have been staying and are in possession of the land for quite some time.
Justice JK Maheshwari dismissed the petitions with observation “looking to the prayer as made in the writ petition and the fact that nothing is available on record to demonstrate that the petitioners are having any right on the land in question and no policy has been produced to indicate that the petitioners may acquire any right on the land to which the relief is sought for”.
