In view of the continuous threat posed by the Covid-19 pandemic, the High Power Committee for the state of Uttar Pradesh on Thursday requested the Allahabad High Court to pass a general order for extension of the period of interim bail, granted to undertrial prisoners (UTPs) and juveniles in the state.

The Committee noted if the UTPs and juveniles, who have been granted interim bail earlier, are readmitted to the jails after completion of interim bail period, the possibility of infection in jails may not be ruled out and it would frustrate the objective of decongestion of jails in the light of the directives issued by Hon'ble Supreme Court.

Accordingly, it has requested the bail period for 14,854 UTPs and 492 juveniles who were released until May 19, 2020 as per the criteria laid down by the Committee, be extended for a further period of 8 weeks.

"Member Secretary, UP State Legal Services Authority is directed to forward the copy of Minutes of this Meeting to; the High Court of Judicature at Allahabad for the purpose of implementation of the recommendations of this Committee," the Committee said.

Inter alia, the Committee has also directed the state Government to extend the period of parole for further 8 weeks to the 2256 convicted prisoners, who have been earlier released as per the Committee's directions.

The UP High Power Committee comprises of Executive Chairman, UPSLSA; Additional Chief Secretary (Home) Govt. of UP and DGP (Prisons) Uttar Pradesh. They had recommended,

"Undertrial prisoners facing criminal cases in which maximum sentence is 07 years and presently confined in jails may be released on interim bail for 08 weeks by the Sessions Court, Additional Sessions Court or the Chief Judicial Magistrate including other Judicial Magistrates, as the case may be, on furnishing personal bond with the undertaking written on the personal bond itself that he/she shall surrender before the Court after expiry of the interim bail period. Other conditions may be imposed by the Court if it thinks fit, considering the circumstances of the case."
