A Bharatiya Janata Party (BJP) MLA from Uttar Pradesh-Ayodhya's Gosaiganj seat, Indra Pratap alias Khabbu Tiwari has been disqualified from the membership of the Uttar Pradesh Assembly following his conviction in a fake mark sheet case by a Special UP Court.

In a notification issued by the Vidhan Sabha Secretariat on December 7, it has been notified that Tiwari would be considered as disqualified from the date of his conviction i.e., October 18, 2021. 

It may be noted that Tiwari has been sentenced by a special court in UP's Faizabad District in a 28-year-old fake mark sheet case. Special Judge of MP-MLA Court, Pooja Singh also imposed a fine of Rs 19,000 on him (in total).

The case was lodged against him in the year 1992 by the then Principal of Saket Degree College in Ayodhya Yaduvansh Ram Tripathi at the Ram Janmabhoomi police station. It was alleged that he had failed in the BSc Part 2 examination, however, he took admission in BSc Part 3, by submitting a fake mark sheet. 

He has been convicted for the Offence u/s 420, 468 and 471.

"The prosecution has been successful in proving the charges leveled against accused persons Phool Chandra Yadav, Kripa Nidhan Tiwari and Indra Pratap Tiwari under sections 420, 468, 47 of IPC beyond a reasonable doubt. Therefore, the accused Phool Chandra Yadav, Kripa Nidhan Tiwari and Indra Pratap Tiwari are liable to be convicted for the above offenses against them," the Special Court held.

Further, the Court came to the conclusion that BJP MLA Tiwari forged the mark sheet to get admission in the next year and his act was of serious nature, and therefore, he was liable to be convicted under the said offences.
