The Supreme Court on Monday issued a notice in a Criminal SLP filed challenging Allahabad High Court's 3 orders of 2022 granting bail to the 5 Accused in connection with the Unnao Gang Rape Victim's Murder Case.
The Bench of Justice Abhay S. Oka and Justice Rajesh Bindal passed this order on the plea moved by the complainant in the case (Anil).
It may be recalled that in May 2022, the Allahabad High Court granted bail to three of the five accused [Umesh Kumar Bajpai, Ram Kishor Trivedi, and Hari Shanker Trivedi] arrested for allegedly setting afire a rape victim in Unnao in the year 2019.
In June 2022, the accused Shubham Trivedi was also granted bail by the High Court.
The background of the case
The 23-year-old woman got lodged an FIR in March 2019, with the intervention of a local court alleging that accused Shivam Trivedi had brought her to Rae Bareli under the pretext of providing employment and raped her in 2017 by giving false assurance of marriage.
The woman had also accused Shivam Trivedi and his cousin Shubham Trivedi of raping her in December 2018. Therefore, the FIR was registered for the offence of gang rape under Section 376D of the Indian Penal Code.
Acting upon the FIR, the police arrested the main accused Shivam in the case. However, he got bail on November 30, 2019, and in an attempt to take revenge on the victim, he, along with 4 others, allegedly attacked the victim in the first week of December 2019 and burnt her by pouring petrol while she was going to catch the train for Rai Bareili in early hours to follow her case.
In his SLP, the complainant has alleged that the accused and their associates were pressurizing and threatening the victim and her family members to make a compromise and settlement in connection with the Gang Rape FIR, which was not agreed by the victim and her family members, and hence, to materialise the threat, all 5 accused committed the offence of burning the victim pouring the petrol on her.
