The UP Government on Wednesday informed the Allahabad High Court that it has transferred the investigation in the BHU Missing Student case to CBCID.

The State counsel submitted before the Court that despite best efforts made by the police, missing person could not be traced and, therefore, now the State Government has decided to handover this matter to the CBCID for further investigation and request to this effect has already been made to the Director General, CBCID by the State Government, vide its letter dated 29.10.2020.

The submission was made before a Bench of Justices Pritinker Diwaker and Pradeep Kumar Srivastava in a PIL filed by Advocate Saurabh Tiwari, an alumnus of the Banaras Hindu University, in relation to the missing student Shiv Kumar Trivedi, who allegedly disappeared from the Police custody in February this year.

The Court has now asked the Government to file latest investigation report done by the CBCID on the next date of hearing, i.e. January 5, 2021.

Notably, Advocate Tiwari had been demanding a CBI probe into the matter. According to him, on the last 2 dates (i.e., on 03 September and on 25th August) the Bench had orally observed that if the local police is unable to find the missing student, it should be ready for a CBI probe in the matter.

In a previous hearing in the matter, the Chief Justice led bench had slammed the Police authorities for filing a 'vague affidavit' instead of giving a complete statement of facts that led to disappearance of the BHU student.

Thereafter, SSP, Varanasi told the High Court that a special team has already been constituted and efforts are on to search the missing student, Shiv Kumar Trivedi. He had also informed the Court that suitable departmental action has been taken against the erring officers.

As per the facts averred in the letter, Trivedi was picked up by certain police personnels from the M.P. Theatre ground, BHU on February 12 and was taken to the Police Station Lanka, District Varanasi. Ever since, there has been no sign of the student. His father made several complaints to senior police officials of Varansai, registered IGRS complaints, etc. but in vain.
