Delhi High Court has passed an order restraining any organisation from holding beauty pageant competitions with the title 'Miss India' or 'Mr India', or with any other title deceptively similar to them.
Justice Mukta Gupta held that using such titles would amount to infringement of trademark enjoyed by the Bennett Coleman group.
In the suit for infringement, the Bennett Coleman group sought a permanent injunction against Rising India Entertainment Production from using the titles 'Miss India' and 'Mr. India' for beauty pageants organised by them.
According to the Petitioner, their company has been organising pageants with the said titles since 1964 and the same have gained great repute both in India and abroad. Moreover, they hold the trademark in the said titles registered in several classes including Class 38 and 41.
The Defendants stated that they were not aware of the Plaintiff's trademarks and in future will not use the same or any deceptively similar marks.
Therefore, the court permanently restrained the Defendants from organizing the event/ beauty pageant under the trademark 'Miss India' or 'Mr. India'.
