The Telangana High Court Advocates' Association has resolved to abstain from work till Saturday, starting today, as a sign of protest against the recommendation of the Supreme Court Collegium to transfer Justice P. V. Sanjay Kumar of the Telangana High Court to the Punjab and Haryana High Court.
The Association has resolved to request the Supreme Court collegium to recall the proposal and to send a delegation to take up the issue with the CJI and judges of SC Collegium, Union Law Minister etc.
The resolution also mentioned the Association's decision to file a Public Interest Litigation in the Supreme Court for framing of guidelines with regard to "appointment of judges, elevation of Chief Justice of Hon'ble High Courts, elevation to Supreme Court and transfer of judges".
The collegium had recommended his transfer "in the interest of better administration of justice" vide resolution dated August 28. However, as a consequence of this transfer, Justice Sanjay Kumar, who is presently the senior most judge of the Telangana High Court, will be placed 12th in the seniority list of Punjab and Haryana High Court.
This has attracted serious criticism from the Advocates' Association which asserts that it was incumbent upon the authorities to appoint Justice Sanjay Kumar as the Chief Justice of any appropriate high court, given that no one from Telangana was a Chief Justice in any high court.
All senior counsels of the high court have also resolved to not appear in the court till Saturday.
