The members/leader of the Tehsil Bar Association Purwa, District Unnao on Wednesday (13th January) submitted before the Allahabad High Court that they will not pass any irresponsible resolution or call for strike hampering the judicial functioning at the Tehsil Bar Association Purwa, District Unnao.
The Bench of Justice Jaspreet Singh was also assured by the members of association that they shall co-operate and create an atmosphere conducive for proper judicial functioning with minimum obstruction and resistance.
Background
Petitioner, one Anita Pandey knocked the doors of Allahabad High Court with her grievance that she had filed an application for mutation before the Naib Tehsildar Asoha, Tehsil Purwa, District Unnao and upon registration of the said application, objections were invited, and since thereafter, the matter remained pending and no substantial progress had been made.
Perusing the order-sheet, the Court found that right from 22th August 2019 till 03rd February 2020, on each of the dates so fixed in the matter, the Members of the Bar abstained from judicial work.
"It is alarming situation where the judicial functioning is being hampered by resolutions passed of the Members of the Bar," the HC had noted in its 19th November 2020 order.
Thereafter, the Court had directed the President of the Tehsil Bar Association Purwa, District Unnao, to be present before the Court on 02nd December 2020 to assist the Court as to find out a solution for avoiding such resolution for smooth functioning of the judicial proceedings.
The Court had also called upon two Advocates, who are Members of the U.P. Bar Council to appear, assist & resolve the aforesaid issue.
On 02nd December 2020, before the Court, Advocate Akhilesh Awasthi (Member of the Oudh Bar Association as well as a Member of the U.P. Bar Council) had offered to render help and use his good officers to visit the local Bar Association to resolve the issue of frequent abstinence of work.
In view of the aforesaid, the Court had put up this matter for further hearing on Wednesday (13th January 2021).
Today, taking note of the aforesaid statement made at the Bar and in view of the aforesaid, the Court observed that no further orders were required to be passed. Accordingly, the petition stood consigned.
The Court appreciated Advocates Akhilesh Awasthi and Prashant Singh Atal "for their efforts and time spent and energy to mobilize their good offices in order to arrive at the consensus for resolving the deadlock."
