A Mathura court today held that the suit to remove the Shahi Idgah Masjid, allegedly built on the land of Shrikrishna Janam Bhoomi is maintainable. With this, the Court overturned a civil court order dismissing the suit in September 2020.

It may be noted that the Mathura's Shahi Idgah Masjid is located next to the Krishna Janmabhoomi, which is believed to be the birthplace of the Hindu deity Krishna.

Significant, a suit had been filed seeking the removal of the Shahi Eidgah (mosque), adjacent to the Shri Krishna temple complex in Mathura, and the transfer of 13.37-acre land to the deity.

However, a civil court in Mathura (U.P) on September 30, 2020, had refused to admit a suit that sought to remove the Idgah mosque on the allegation that it was built over the Krishna Janam Bhoomi, the birthplace of Lord Krishna.

Thereafter, the Mathura District Court on Friday (16th October 2020) had admitted the appeal filed against the order of Civil Judge, Mathura.

Notably, the civil appeal was preferred by 'Bhagwan Srikrishna Virjman', through next friend Ranjana Agnihotri, 'Shree Krishna Janmbhoomi'—the place of birth of Lord Shree Krishna and six devotees.

The Appellants had submitted in the civil appeal that the Civil Judge was wrong in dismissing their suit inasmuch as they are worshippers of Lord Shri Krishna and they have the right to assert their right to religion guaranteed by Article 25 of the Constitution to have Darshan and perform puja at the actual birth of place of Lord Krishna which is at present beneath the structure illegally raised by Muslims.

After hearing the parties, the Court had reserved its verdict on May 5.

In related news, the National Treasurer of All India Hindu Mahasabha, Dinesh Kaushik, has moved an application before the Civil Judge Senior Division Mathura seeking permission to consecrate Laddu Gopal inside Shahi Idgah Mosque and to perform the Puja path there.

Mathura's Shahi Idgah Masjid is located next to the Krishna Janmabhoomi, which is believed to be the birthplace of the Hindu deity Krishna and the instant application alleges that the said Masjid was built after demolishing an Ancient Temple

On Tuesday (May 17), an application was moved before a local court in Mathura with a prayer to seal the disputed Idgah mosque complex. The petitioners, Advocates Mahendra Pratap Singh and Rajendra Maheshwari moved the application claiming that if the disputed premises is not sealed, then the religious character of the property will be changed.

The application also demands that the security of the Shahi Idgah Mosque premises should be increased, any kind of movement should be banned and security officers should be appointed. The Civil Judge Senior Division Court is likely to hear this petition on July 1.

Referring to the Varanasi Court's order to seal the spot of Gyanvapi Mosque premises where the advocate commissioner reported the finding of Shiva Linga in the survey, the application states that Idgah Mosque premises too, needs to be preserved immediately as evidence, or else the parties in possession can destroy them.

It may be noted that on May 13, an application was moved by one Manish Yadav in the court of Civil Judge (Senior Division), Mathura, seeking the appointment of an advocate commissioner to carry out an inspection of the Shahi Idgah Masjid.

In his application, a prayer was made to appoint a senior advocate, an advocate commissioner, and get a video survey done of Shahi Idgah immediately in view of the fact that Hindu religious symbols are present inside the mosque.

The Allahabad High Court has recently directed a local court in Mathura to decide on two applications pending before it, filed in connection with the Sri Krishna Janambhumi Dispute, within 4 months.
