Six persons who were arrested by the Uttar Pradesh Police for allegedly offering namaz in Lucknow Lulu Mall have been granted bail on Thursday by a local Court in Lucknow.
The Court of Additional Chief Judicial Magistrate, Lucknow granted bail to Accused Mohammad Adil, Mohammad Sayeed, Mohammad Irfan, Mohammad Atif, Mohammad Rehan, and Mohammad Luqman on the condition of furnishing a personal bond of ₹20K and two sureties each in the like amount to the satisfaction of the Court.
Speaking to Live Law, his advocate Zeeshan Alvi said their clients did not offer the namaz, and even if they did, the arrest was illegal as the accused were not issued notice as mandated by Section 41A CrPC and that the UP police did not follow the guidelines issued in Arnesh Kumar and Satender Kumar Antil cases.
It may be noted that the Lucknow police had booked them under 153A (1), 341, 505, and 295A IPC which carry less than 7 years of imprisonment.
Essentially, a controversy broke out on July 12, after a video of a group of persons offering Namaz allegedly without permission at Lulu Mall surfaced on social media. Thereafter, the administration of Lulu Mall lodged a report at Sushant Golf City Police Station regarding this incident. These five accused are residents of the same locality.
