Special NDPS Court Grants Bail To Showik Chakraborty In Drugs Case

Special NDPS Judge GB Gurao granted bail to the 24-year-old son of a former army officer who has been in jail for almost three months, on a personal bond of Rs.50,000.

Showik has been in Taloja jail since September 5 and was arraigned as an accused under Section 8(c) read with Sections 20(b)(ii),22,27A,28,29 and 30 of the NDPS Act, 1985.

It is the NCB's case that Showik Chakraborty gave a statement to them revealing that he used to facilitate the delivery to arrange drugs through accused Abdel Parihar by accused Kaizan Ebrahim and accused Zaid Vilatra. These deliveries used to be received by aides of Late Sushant Singh Rajput and every delivery and payment was in knowledge of Showik's sister and co accused Rhea Chakraborty, NCB alleges.

However, appearing on behalf of Showik Chakraborty, Advocate Ayaz Khan relied upon a recent judgment of the Supreme Court in Tofan Singh Vs State Of Tamil Nadu wherein it was held that confessional statements made to officers authorised to investigate NDPS cases are not admissible. Adv Khan submitted that his client has been falsely implicated in the case.

Apart from Showik and his sister Rhea, Zaid Vilatra, Anuj Keswani, Abdel Basit Parihar, Kaizen Ibrahim are other accused in the case. In an order dated October 7, Bombay High Court granted bail to Rhea Chakraborty and others, but Showik and Abdel Parihar were denied bail.
