Delhi High Court Bar Association has formulated a scheme to disburse funds collected for providing financial assistance to the members of the Delhi High Court Bar Clerks Association.

The Single Bench of Justice Rekha Palli was further informed that that DHCBA has finalised a scheme for creation of a fund, built on the contributions or donations received from its members.

The court was further informed that for the purpose of the said fund, a separate bank account will be created and all donations shall be made in favour thereof.

However, the Petitioner Association submitted, this account will be operated by their office bearers itself and shall be subject to the supervision of the DHCBA as also two of its members: Mr. Mohit Gupta, Treasurer and Mr. Nagender Banipal, Executive Member.

This information was provided in a plea moved by DHCBCA seeking financial assistance for the clerks who are finding it extremely difficult to make ends meet due to loss of work caused by the lockdown.

In the previous hearing, Senior Advocate Mohit Mathur, who was appearing for the DHCBA, had sought time to formulate a scheme to develop a fund for the members of the DHCBCA.

Mr Mathur had proposed to monitor this fund by way of a committee comprising of some of its office bearers to ensure that the amounts released by way of aid, were effectively distributed and reached only those members of the petitioner association who were experiencing bona fide hardship and were not receiving monthly salaries from the employer.

In light of the submissions made by the Bar Association, Senior Advocate Inderbir Singh Alag submitted that he's satisfied with the action taken by the Respondents and asked the court to dispose of the petition by granting liberty to the Petitioner to again approach this Court in respect of the reliefs sought against the remaining respondents, if the need so arises.

While disposing of the petition, the court noted that:

'The petition is, accordingly, disposed of with liberty as prayed for and the hope that more members of the respondent association and civil society will empathise with the plight of the members of the petitioner association and feel compelled to contribute generously to the fund proposed to be set up.'
