SC Refuses To Stay HC Judgment Annulling Election Of Azam Khan's Son As UP MLA

The Supreme Court on Friday declined to stay the Allahabad High Court's annulment of the election of Samajwadi Party leader Azam Khan's son as an MLA from Suar, UP for having been underage at the time of filing nomination papers.

Noting Abdullah Azam Khan's CBSE school certificate which shows him to not have completed the stipulated age of 25, the bench headed by Chief Justice S. A. Bobde, however, issued notice on the plea and agreed to examine it.

"We are not satisfied. We are issuing notice because there seems to be some doubt", said the bench, also comprising Justices B. R. Gavai and Surya Kant. Senior Advocate Kapil Sibal, appearing for Abdullah, had placed reliance on hospital records and maternity leave details to press for a stay on the annulment.

"Please don't be indignant. We will not stay the High Court's judgment. It is not as if it is based on nothing", said the bench.
