A single bench of Rajasthan High Court, Jaipur directed the state to keep a constable post vacant in constable recruitment exam 2019 under MBC female category for a candidate wrongly denied benefit of 4 marks for LLB degree, till further orders.
Justice Mahendar Kumar Goyal, observed, "Taking into consideration the contentions advanced by the learned counsel for the petitioner and the material on record, this court directs the respondents to keep one post of Constable under the MBC female category vacant, till further orders".
The court issued notice after hearing the petitioner on interim relief.
The petitioner alleged that she was wrongly denied the benefit of four marks for her LLB Degree.
Appearing on behalf of the petitioner, Adv. Sudesh Kasana submitted that if the petitioner was awarded these marks, then she would have secured higher marks than the cut off marks under Most Backward Category- Female, and thus, making the petitioner entitled for appointment on the post of Constable in pursuance of recruitment examination of 2019.
In this regard, the court ordered, "Rule is made returnable by five weeks. Notice be filed in two sets. One set of notices be sent through registered post with acknowledgement due. Steps to be taken within a week".
