Punjab & Haryana High Court Grants Bail To British National Accused Of Targeted Killings Of RSS Leaders In Punjab [Read Order]

A Bench of Justice Anupinder Singh Grewal ordered,

"In view of the submissions of the learned counsel for the petitioner, especially when the petitioner has been arraigned as an accused on the statement of co-accused; nothing has been recovered from the petitioner; he is in custody for over 03 years; he is not involved in any other case; co-accused have been granted regular bail; the COVID-19 pandemic, and the conclusion of the trial is likely to take some time, I deem it a fit case to grant the concession of regular bail to the petitioner."

Jaggi was booked for the offences of under Sections 419-420 (Cheating), 467, 468 and 471 (Forgery) and 120-B (Criminal Conspiracy) of IPC, Section 25 of the Arms Act and Sections 17/18/19/20 (Terrorism) of the Unlawful Activities (Prevention) Act, 1967 by the Punjab Police. He was arrested in November 2018 from Jalandhar, when he was visiting India to attend a marriage.

In his bail plea, Jaggi had contended that he was not named in the FIR and had been arraigned as an accused on the statement of co-accused. He, however, contended that nothing had been recovered from him till date and no overt act was attributed to him.

He also contended that similarly situated co-accused, namely, Jagjit Singh and Dharaminder Singh @ Gugni had also been granted regular bail in the matter.

The State counsel on the other hand submitted that Jaggi, along with other accused, was involved in unlawful activities and had been instigating witnesses.

The Court has however allowed the bail plea and ordered that he be released on regular bail on his furnishing requisite bonds to the satisfaction of the trial Court/Duty Magistrate concerned.
