Prayagraj Violence: Local Court Denies Bail To Welfare Party Of India Leader Javed Mohammad

A local court in the Prayagraj District of Uttar Pradesh on Thursday denied bail to the prime accused in the June 2022 Prayagraj Violence case, Javed Mohammad. 

The Uttar Pradesh police have alleged that he had given a call for the protest (which turned violent) against the controversial statements of BJP leader on the Prophet Mohammad.

Denying him bail, the Additional Sessions Judge Ratnesh Kumar Srivastava observed thus:

"...prima facie this case is related to spreading communal frenzy on a large scale, attacking police forces and civilians with bombs and firearms and damaging government vehicles, which were brought under control by using (police) force and means. Therefore, keeping in view the facts and circumstances (of the case), without expressing any opinion on the merits of the case the ground for releasing the accused on bail is not sufficient."

It has been alleged that on June 10, 2022, after the Friday prayers, a furious crowd of thousands of people started pelting stones and bombs on the policemen and passers-by an they also tried to snatch the mobiles of police employees and threw stones at them, which were fatal as many personnel got injured.

As per the allegations, the protest turned violent after the protestors started pelting stones at security forces personnel while chanting slogans and when the Rapid Action Force (RAF) and Provincial Armed Constabulary (PAC) used lathi charges to disperse the crowd, some personnel got injured due to the stone-pelting, that was being done from the side of the protestors. Police vehicles were also damaged during the protest.

A case was registered against 5000 unknown persons under Sections 443, 444, 445, 447, 448, 449, 453A, 453B, 295A, 204, 544, 307, 332, 333, 353, 395, 435, 436, 427, 504, 505(2), 506, 420B IPC, 4,/5 Explosive Substance Act and 83 of Juvenile Justice (Care and Protection of Children) Act and 3/4 Prevention of Damage to Public Property Act

On June 10 Bail applicant Javed was arrested and thereafter, his wife and daughter were also detained, however, they were released subsequently. Further, on June 11 a notice was given by the Municipal Authorities to the accused stating that his house shall be demolished and therefore, they should vacate the house. Consequently, on June 12, the house was demolished completely.

Against this, a plea has been moved by the wife of accused Javed Mohammad challenging the decision taken by the district administration and Prayagraj Development Authority (PDA) to demolish their house.
