The Allahabad High Court last week granted bail to the Welfare Party Of India Leader Javed Mohammad in another case pertaining to the June 2022 Prayagraj Violence incident. He has been accused of leading the mob which allegedly damaged public property and set police vehicles on fire.

The bench of Justice Ajay Bhanot granted him bail as it noted that the counsels for the state could not satisfactorily refute the arguments made by the counsels for Javed Mohammad.

Consequently, Mohammad @ Pump was ordered to be released on bail in the case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court below.

Javed had moved the Court seeking bail in the instant case lodged against him under Sections 143, 144, 145, 147, 148, 149, 153-A, 153-B, 295-A, 201, 511, 307, 332, 333, 353, 395, 435, 436, 427, 504, 505(2), 506, 120-B IPC, Section 4/5 of the Explosive Substance Act and Section 7 of Criminal Law Amendment Act, Section 83 of the Juvenile Justice Act, Section 3/4 of the Public Property Damages Act and Section 3 of the Explosive Substance Act.

Before the Court, appearing for him, Senior Counsel S.F.A. Naqvi assisted by Syed Ahmed Faizan argued that Javed is a law-abiding citizen who holds the unity of the country and amity between various communities very close to his heart.

It was also submitted that he neither posted nor shall post any messages which disrupt social harmony in the society and that he had been scapegoated as he has opposed to certain powerful political interests. 

It was further argued that there is no credible evidence to establish that the applicant instigated the mob or indulged in acts of violence and that he cannot be called a media influencer and does not have a wide following who would congregate at his call.

Certain other arguments were made and it was assured to the Court that he shall not influence witnesses or tamper with the evidence. Consequently, without making any observations on the merits of the case, the bail application was allowed by the HC.

It may be noted that this is one of the 5 cases registered against him pertaining to the Prayagraj Violence incident. In two cases he has been granted bail by the lower court. While in one case, he was granted bail by the Allahabad High Court last month.

Last month, the bench of Justice Sameer Jain observed that from the perusal of the FIR and the statements of prosecution witnesses recorded during the investigation, it appears that general allegations were made against all the accused persons including the applicant.

"It is neither alleged in the FIR nor in the statements of prosecution witnesses recorded during the investigation that applicant was either instigating the people or was leading the mob or he was having any weapon in his hand or was hurling bomb or set the vehicles on fire," the Court categorically observed as it found it a fit case to grant him bail.
