The Delhi High Court last week asked the Ministry of Petroleum and Natural Gas & Ministry of Social Justice & Empowerment, as to whether a policy has been framed for allocation of petrol pumps under the Rights of Persons with Disabilities Act, 2016.
The Bench of Justice Prathiba M. Singh was hearing the plea of one Deepti Lenka (along with others) who is suffering from a disability and she submitted before the Court that she was not being considered for allocation of a petrol pump.
The Petitioners had complained to the Chief Commissioner for Persons with Disabilities (Divyangjan), who had, vide the impugned order dated 24th December 2020, rejected the Petitioners' prayer.
However, the Commissioner had recommended that the Respondents consider revising/reframing their policy.
Further, the Court directed,
"Let counter-affidavits be filed, both by the Ministry of Petroleum and Natural Gas and the Ministry of Social Justice & Empowerment, as to whether a policy has been framed for allocation of petrol pumps under the Rights of Persons with Disabilities Act, 2016."
Also, the Hindustan Petroleum Corporation Limited has been asked to file a counter affidavit within six weeks.
The matter has now been posted for further hearing on August 25.
