Dealing with a plea seeking direction to Union of India and Delhi Government seeking conversion of open spaces for eg. vacant Stadiums and seeking a direction to the Government to set-up drive-in vaccination centres in Delhi, the Delhi High Court today disposed of the plea by directing the Government to treat the plea as representation.

A division bench comprising of Chief Justice D. N. Patel and Justice Jasmeet Singh directed that the plea be treated as representation and it be decided in accordance with the law.

The plea before the Court

The Petition filed by Amandeep Aggarwal, through Senior Advocate, AS Chandhiok, Advocate Rushab Aggarwal & Advocate Priyanshi Chokshi sought setting up of such drive-in vaccination centres whereunder the citizens can drive into a vaccination centre and get themselves vaccinated without coming in contact with others and maintaining social distancing, similar to the ones set up by the Brihanmumbai Municipal Corporation in Mumbai.

Underlining that the purpose of imposing a lockdown would be defeated on account of crowding at vaccination centres and hospitals, the plea stated,

"The Brihanmumbai Municipal Corporation (Municipal Corporation of Greater Mumbai) has implemented Drive-in vaccinations in Mumbai whereunder the citizens can drive into a vaccination centre and get themselves vaccinated without coming in contact with others and maintaining social distancing."

Thus, the Petitioner filed the petition seeking conversion of open spaces for eg. vacant Stadiums and seeking a direction to Delhi Government to set up drive-in vaccination centres in Delhi.

Prayers in the plea 

  • Direction to the Delhi Government to forthwith plan and implement Drive-in Vaccinations for COVID-19 for all citizens of Delhi; and
  • Direction to the National Disaster Management and State Disaster Management to forthwith identify appropriate sites such as vacant Stadiums to implement Drive-in Vaccinations for COVID-19 for all citizens of Delhi and to consequently declare such sites as having been made available to the Delhi Government for the aforesaid purpose; and
  • Direction to modify the CoWIN website and the Arogya Setu app to include such drive-in vaccination centres, so identified.
