A plea has been moved in the Delhi High Court seeking action against the Chairman of the Delhi Minorities Commission, Zafar-ul Islam Khan, for allegedly making inflammatory and threatening statements against the Hindu community.
Moved through Advocate Siddharth Acharya, the petition cites a Facebook post put up by Zafar-ul Islam Khan on April 28 which allegedly referred to Hindu Community as 'Hindutva Bigots' and threatened the entire community of dire consequences.
'(Khan) has intentionally and extremely cleverly, with an intention to cause a rift between two religions at such a sensitive time when India has been affected by global pandemic of Coronavirus and has accused the Hindu Religion of causing lynching, riots and professing hate campaigns against Muslims without provision any substantial proof', the petition states.
The Petitioner argues that the Chairman of the Delhi Minorities Commission should've kept in mind that the city recently experienced deadly communal riots in its northeast districts.
He further argues that Mr Khan made these statements with a malafide intention to malign the entire Hindu community, and the same can lead to an endless cycle of violence.
The petition states:
'That the notion has been created that the Muslim minority of Country cannot secure justice from the Courts of Law and the justice system has time and again failed Muslims in the country, thus resorting to idea of vigilantism.'
While highlighting that the Chairman of the Delhi Minorities Commission has allegedly violated sections 153A, 295A, 505(2) of the IPC, as well as section 66A of the IT Act, the jurisdiction to secure ends of justice lies with the High Court as the said alleged crimes are committed by a Chairperson of a statutory commission, and not by a normal individual.
