Plea Alleging Illegal Detention Of 2 Nigerian Nationals Since September 2019: Allahabad High Court Seeks Govt. Response

The Bench of Justice Ramesh Sinha and Justice Samit Gopal was hearing the Habeas Corpus Petition filed by petitioners Chinasa Victor Obioha and Chima Paul Ugochukwu [Nigerian Nationals] through their next friends and wives.

Prayers

It has been alleged in the Petition that both the Petitioners were illegally detained at Surajpur Police lines, 49 Battalion, Greater Noida, Uttar Pradesh and are under detention since 24^th September 2019.

Further, it has been prayed before the Court that they be released with immediate effect and the respondents be directed to produce before the Court, all the documents/cases made or registered pertaining to the illegal detention of the 2 Nigerian Nationals from the first date of their detention i.e. from 24th September 2019.

Importantly, the Petitioners have prayed before the Court that their application for grant of Long Term Visa be considered sympathetically and they be granted Long Term Visa as per the internal guidelines of MHA.

The counsel for the petitioners stated that "the petitioners are foreign nationals and they have been illegally detained by the respondents without being any case pending against them."

Further, the Counsel for the petitioners also stated that "the petitioners have not even been produced before the Magistrate till date."

Hearing the petition, the Court ordered,

"Learned Counsel appearing for the Union of India and learned A.G.A. for the State shall seek instructions in the matter within three days."

The matter has been listed for further hearing on Wednesday (18^th November)
