'Unpacking The Shift From Penal To Nyaya': ILI Patna In Collaboration With Bihar Judicial Academy & BSLSA Hosts Talk On Bhartiya Nyaya Sanhita

The Indian Law Institute (ILI), Patna, in collaboration with the Bihar Judicial Academy and Bihar State Legal Services Authority, organized a comprehensive talk shedding light on the Bhartiya Nyaya Sanhita, titled "Unpacking the Shift from Penal to Nyaya." Under the guidance of the Patna High Court, the event aimed to delve into the transformative aspects of the new legal framework.

The event, graced by esteemed dignitaries, included Justice K. Vinod Chandran, Chief Justice of the Patna High Court and Patron in Chief of Bihar State Legal Services Authority and Bihar Judicial Academy.

Justice Ashutosh Kumar, JAD-1 of the Patna High Court and Designate Executive Chairman of Bihar State Legal Services Authority, along with Justice Vipul M. Pancholi, JAD-II of the Patna High Court, also attended, alongside other Judges of the Patna High Court.

Dr. Jyoti Dogra Sood, Professor at ILI, served as the Key Speaker, while the session was moderated by Ms. Avantika Tiwari, a Research Scholar at ILI.

Chief Justice K. Vinod Chandran addressed the audience, highlighting the societal journey from Regressive law to Progressive law, emphasizing the shift from retributive to reformative punishment under the new Sanhita.

Justice Ashutosh Kumar underscored the significance of the new law, labeling it as the most substantial change in law in the last 160 years. He elaborated on key concepts such as the introduction of new offenses and zero tolerance for organized crime and terrorism, emphasizing that law is a remedy for the poor, not just a luxury for the rich.

Dr. Jyoti Dogra Sood critically discussed the Bharatiya Nyaya Sanhita, emphasizing the distinction between Justice and penal Justice. She also delved into the history of the Indian Penal Code's codification, highlighting the time-consuming process.

Furthermore, she pointed out the lacunae in Bharatiya Nyaya Sanhita, noting the reduction of judicial discretion due to minimum punishments for certain offenses.

A brief presentation on Bharatiya Nyaya Sanhita was delivered by Probationary Civil Judges.

Mr. Ashok Kumar Pandey, Director of Bihar Judicial Academy and Secretary of ILI, Patna Chapter, delivered the Welcome address, expressing gratitude to the attendees.

The vote of thanks was delivered by Ms. Shilpee Soniraj, Member Secretary of Bihar State Legal Services Authority, Patna, and Joint Secretary of ILI Patna Chapter.
