Priyanka Singh and Meetu Singh, deceased actor Sushant Singh Rajput's sisters, have filed a writ petition before the Bombay High Court for quashing of FIR filed against them by Mumbai police on actor Rhea Chakraborty's complaint. The petitioners have also contended that the FIR against them was clearly a counter-blast to the FIR filed against Rhea Chakraborty by their father in Patna.

The matter came up before the division bench of Justice SS Shinde and Justice MS Karnik on Tuesday. Advocate Varun Singh appeared on behalf of the petitioner sisters Priyanka and Meetu Singh along with Advocate Madhav Thorat.

The FIR was registered on September 7 and needs to be quashed as it is not maintainable. The late actor Sushant Singh died on June 14 and Rhea (Respondent No.2) left his home on June 8, Adv Singh submitted. Referring to the allegations made in the FIR, Singh pressed for relief and said that Sushant's sister Priyanka along with a doctor prescribed some medicines to Sushant and for this she has been booked under Section 306 (abetment of suicide) of IPC and provisions of Narcotics Drugs and Psychotropic Substances Act.

On the other hand, Rhea Chakraborty's lawyer Advocate Satish Maneshinde's junior sought some more time as he was appearing before another bench.

"There is no urgency in the matter, investigation is on. We do not want to interfere at this stage", Justice Shinde said, directing Advocate Singh to serve CBI and adjourned the hearing to October 13.

The petition states-

"The FIR is not only in the teeth of the order of the Hon'ble Supreme Court's judgment dated August 19, 2020 in Rhea Chakraborty vs State of Bihar, but is also a blatant attempt to derail the ongoing investigations by the Central Bureau Of Investigation (CBI) and other agencies who have taken cognizance of various facts emerging in pending investigation and pending FIR."

Petitioner sisters have been booked Sections 420 (cheating and dishonestly inducing delivery of property), 464 (making a false document, 465 (punishment for forgery), 466 (forgery of record of court or of public register, etc), 468 (forgery for purpose of cheating), 474 (having possesion of document), 306 (abetment of suicide) and 120B (criminal conspiracy) of the Indian Penal Code.

The FIR also states-

"The registration of present FIR amounts to travesty of justice and shows that the present FIR was registered in a mechanical manner. In the present FIR it is alleged that the prescriptions given by Dr.Tarun Kumar are forged. However, there is not even an iota of allegation to suggest that the alleged prescription was forged, neither has Respondent No.1(State of Maharashtra) done any preliminary enquiry to ascertain the said fact which is evident from the fact that the complaint was received at police station on September 7, 2020 at 7:30 pm and FIR was registered on the same day without any preliminary enquiry and without application of mind by Respondent No.1."

Thus, quashing of FIR registered at Bandra Police Station against the petitioners has been sought.
