Observing that right to get education is a fundamental right, a Delhi Court has allowed a murder accused to appear in the All India Law Entrance Test, 2022 conducted by National Law University, Delhi to be held on June 26.

Vacation Judge Chandra Shekhar of Rouse Avenue Courts thus allowed the application filed by one Shashank Jadon seeking permission to appear in the said entrance exam, after noting that a similar request made by him the year 2020 was allowed by the concerned court.

Jadon was accused in a CBI case, FIR for which was registered in the year 2015 under sec. 302 and 34 of Indian Penal Code.

"Therefore, the concerned Supdt. Jail at Dasana Jail is directed to make necessary arrangements to ensure the appearance of accused in the aforesaid examination at the aforesaid centre at appropriate time as detailed in this order and in copy of admit card. annexed with the application and thereafter to take him back to the concerned," the Court observed.

The Court added that the jail superintendent shall allow the accused to carry the necessary documents or articles as mentioned under the heading "Instructions to candidates" in admit card.

"It is observed that as per law right to get education is a fundamental right and judicial record shows that similar request made by the accused in the year 2020 was allowed by the concerned court vide order dated 19.09.2020, therefore, it seems that it is in the interest of justice, if permission is granted to the accused to appear in All India Law Entrance Test to be held on 26.06.2022 in between 10:00 to 11:30 a.m. at Lloyd Law College," the Court ordered.

The Court also directed the concerned jail superintendent to file a compliance report on June 28.
