The Madhya Pradesh High Court, Gwalior Bench recently allowed the bail application of a murder accused with one of the conditions being that he installs water recharge/ harvesting system at his residence.

The bench comprising Justice Anand Pathak expects that such direction would create an atmosphere of awareness among the public about water conservation-

This direction is being given by this Court in peculiar fact situation and looking to the intent and desire of the applicant to do some work for the betterment of Environment and Community. It is earnestly expected that this act of applicant would create an atmosphere of awareness in the public regarding water conservation.

Facts of the case are that the Applicant is accused of offences punishable under Section 302, 307, 147, 148 and 149 IPC and was under custody for more 22 months. He submitted before the Court that the material witnesses were already examined and therefore, his chances of tampering with the evidence were remote. He further assured the Court that he would cooperate with the investigation and that he would not be a source of embarrassment to the Complainant. He also undertook to "serve the environmental/national/social cause voluntarily to purge his misdeeds, if any."

Examining the submissions of parties and documents on record, the Court found the case of the Applicant to be fit for grant of bail. Accordingly, the Court directed the release of the Applicant subject to a set of conditions, one of which requires him to install a Water Harvesting System at his residence-

Looking to the undertaking and intent of the applicant and looking to the fact that water is depleting day by day and this area is anticipated to come under Zero Day zone, it is imperative that applicant must install Water Harvesting System or Water Recharge System in his lodge / house in which he is residing, within one month from today, if he has not installed the system already. If he has installed the system already, then he shall have to submit proof and photographs regarding this before the trial Court. Applicant shall seek necessary permission required, if any, in this regard from the concerned departments including Municipal Council of concerned District and authorities shall facilitate and cooperate in this regard for installation of water recharge / harvesting system.

With the aforesaid directions, the bail application moved by the Applicant was allowed.
