A letter petition has been moved before the Allahabad High Court seeking CBI probe into the recent violent incident of Lakhimpur Kheri in which a total of 8 people died, four of whom were mowed down by a vehicle allegedly being driven by the son of Union Minister of State for Home Affairs and BJP MP Ajay Kumar Mishra.
The plea moved by Swadesh NGO and Prayag Legal Aid Clinic through advocate Gaurav Dwivedi avers that the State Government of Uttar Pradesh failed to Secure the Right to Life and Personal Liberty guaranteed by Article 21 of the Constitution of India of the deceased persons.
The plea further states that due to this dreadful incident, the law and order of the State of Uttar Pradesh is in great danger and any miss happening may take place if preventive actions are not taken by the state at an earliest.
Alleging that the incident points to the law-and-order situation prevailing in the state and also towards the neglected behavior of securities agencies against a VIP movement, the plea states thus:
"This incident shows the real face of law and order in the State of Uttar Pradesh where a State machinery by the help of Police and through its Intelligence force i.e Local Inspection Unit (LiU) keep an eye to the securities measures adapted before any VIP Movement but an incident which took place at Lakhimpur Khiri opened the real and neglected behavior of securities agencies against a VIP movement and as well as against protestants."
Prayers in the plea:
- Direction to the State of Uttar Pradesh to recommend and conduct a CBI inquiry into the matter of death 8 persons who died in a dreadful massacre at Lakhimpur Khiri," U.P on dated 03.10.2021.
- Direction to the State of Uttar Pradesh and other authorities to initiate an enquiry on account of the death of 8 persons
- Initiation of an independent judicial inquiry under the monitoring of this Court in the present matter.
- Direction to the State of Uttar Pradesh to initiate an enquiry by Special Investigating Agency in the present matter.
The plea has impleaded the State of U.P, Director General Of Police, Uttar Pradesh, Commissioner, Lakhimpur Kheri, District Magistrate, Lakhimpur Kheri, Senior Superintendent of Police, Lakhimpur Kheri, and Station House officer, Tikonia Banbirptir Road as respondent parties.
About the incident
On October 3, several farmers were holding protests against the visit of Uttar Pradesh Deputy Chief Minister Keshav Prasad Maurya to Lakhimpur Kheri district, when four protesting farmers were killed after they were mowed down by an SUV.
Allegedly, the SUV was the part of the convoy of Union Minister of State for Home Affairs and BJP MP Ajay Kumar Mishra
Yesterday, the police filed a first information report against Ashish Mishra (son of minister Ajay Kumar Mishra) and several others in connection with the violence under Section 302 IPC.
An alleged video of the incident has also surfaced in social media showing a group of protesters moving forward on a road next to farm fields and then being mowed down by a grey SUV that speeds up from behind.
The Uttar Pradesh government has announced that a retired High Court judge will probe the Lakhimpur Kheri violence and also, 45 lakh compensation would be given to the families of the four farmers killed in the incident.
