Ernakulam Sessions Court granted interim protection from arrest to MLA Mukesh in a rape case.

The complainant had alleged that the petitioner sexually abused her when she approached him to take a membership to the Association of Malayalam Movie Artists. An FIR was filed against the cine-actor in the Maradu Police Station.

In the wake of publication of Hema Committee Report, many film artists had come public with the adverse experiences in the nature of sexual offences, which they had to undergo at the hands of some people from the industry. The State Government constituted a Special Investigation Team to investigate into the allegation of sexual assault.

The complainant herein has given her statement to the SIT. Offences under Section 354 (Outraging the modesty of woman using criminal force), 376 (rape), 509 (Insulting the modesty of woman using words or gestures) IPC have been invoked.

In his petition, Mukesh has referred to an e-mail in which the complaint allegedly expressed her happiness to him for being decent and kind to her. He further pointed that alleged incident is of 2009 and claimed that the complainant filed a complaint now only to tarnish his political and film career.

The petition was moved by Adv. Geo Paul
