Chief Justice A J Desai of the Kerala High Court has issued guidelines to be followed by judges regarding the signing and uploading of orders/judgments and the use of Chambers and Staff on their Retirement/Transfer/Elevation.
Use of Chambers
Judges are refrained from using chambers after the date of retirement. It is also stated that staff of the judge shall hand over all case records to the Registry before 04.30 PM on the 3rd working day after the date of retirement. In cases of elevation and transfer, judges shall retain their chambers for periods accepted by the Chief Justice.
Uploading Of Judgments
The memorandum states that Judges are required to hand over signed orders/judgments of all reserved cases to the registry before the last working day, or maximum by midnight of the day of retirement. In case any orders/judgments are not ready by the midnight of the date of retirement, Judges shall hand over such cases to the Registry.
It adds that the Staff of the High Court is prohibited from uploading any orders/judgments after three working days from the date of retirement of the judge and that the Registrar (Computerization) cum Director (IT) shall ensure this.
Retaining Personal Staff
The notice states that Judges could retain staff except co-terminus sevaks for one month, extendable with the approval of the Chief Justice.
Last Friday, the Kerala High Court Advocates' Association President, Shri Yeshwanth Shenoy wrote a letter to the Chief Justice alleging that Justice Mary Joseph was continuing to write judgments even after retirement on June 02.
