Earlier, the court had dismissed his first bail application observing that there are serious allegations against the former minister and thus he is not entitled bail on merit at this stage.
In the second bail application, it was contended that his health condition has been dangerously deteriorated. Considering his plea, the court noted that the first bail application was dismissed with an observation that the accused can file a fresh petition for bail once he is removed from the hospital to the jail.
"After dismissal of the earlier petition, there is admittedly a change of circumstance as far as the health condition of the petitioner is concerned. As far as the contents in ground (H) of the bail application and the certificates produced by the petitioner, the State Attorney submitted that there is no dispute on that. If that is the case, I think the petitioner can be released on medical ground with stringent conditions. There can be a direction that the petitioner shall not leave the jurisdictional limit of Ernakulam district along with other conditions", Justice PV Kunhikrishnan observed.
The court has also imposed several conditions.
Ebrahim Kunju was arrested by the Vigilance and Anti Corruption Bureau on November 26. A vigilance court had earlier dismissed the bail plea filed by former minister V K Ebrahim Kunju, arrested by the Vigilance and Anti-Corruption Bureau (VACB) in a flyover scam case. The Muvattupuzha Vigilance court also dismissed a vigilance application seeking his custody but permitted the agency to question the ailing former minister few hours a day at a private hospital in Kochi where he is admitted for treatment of cancer.
