The Allahabad High Court on Thursday sought the response of Superintendent of Police, Kasganj within ten days on the plea filed by the father of Kasganj Custodial Death victim, Altaf.
The plea has been moved by Chand Miyan (father of the Victim) seeking a CBI probe into the matter wherein it has been claimed by the Uttar Pradesh Police that Altaf died by suicide by tying himself to a 2 to 3 feet pipe.
The petitioner has, in the alternative sought direction for the constitution of a Court Monitored Special Investigation Team (SIT) to take over the investigation in the Case and to proceed against all the concerned police officers and other persons who are found to be involved in the matter.
The petitioner has also sought a compensation of Rupees One Crore as the state failed to prevent the custodial death of the petitioner's son.
Hearing the plea, the Bench of Justice Mahesh Chandra Tripathi and Justice Subhash Vidyarthi asked the Superintendent of Police, Kasganj to file a response/affidavit in the matter within ten days.
It may be noted that the Allahabad High Court last week sought the reply of the Uttar Pradesh Government, Union Government, and others on a plea filed by People's Union For Civil Liberties (PUCL) seeking the establishment of Fast-Track Special Police Courts.
PUCL's plea has been filed in the backdrop of the Kasganj Custodial Death Case. PUCL has also sought a 2nd Post Mortem on the body of the Kasganj Custial death victim, Altaf.
Case background
Altaf was found dead at the police station on November 9 and it was claimed by the Police that he had hanged himself with a drawstring from the hood of his jacket, using a water pipe in a toilet that is a couple of feet from the ground.
Altaf, a 22-year-old man was detained by UP police over a minor girl going "missing" in the Kasganj district of Uttar Pradesh, however, she has now been found from Kasganj railway station.
An FIR against unidentified policemen, under IPC Section 302 (murder) has already been lodged at the Kasganj police station in connection with Altaf's death. UP officials have said that a departmental inquiry and a magisterial probe into the custodial death are being conducted simultaneously.
Advocates Ali Qambar Zaidi, Mohammad Danish and Kumail Haider appeared for the petitioner/Chand Miyan.
