Two accused named in the alleged Police Sub Inspector (PSI) recruitment scam have approached the Karnataka High Court, seeking to quash the First Information Report (FIR) registered against them on April 30.
The accused Rachana Hanumantha and Jagrut, are among candidates aspiring for the post. Their plea states that the examination was held almost a year ago and the FIR is registered after the results were announced. The case of the prosecution against the petitioners is false and illegal. Further it is alleged that wicked elements are utilising the present false case as a tool against the petitioners to harass them and deprive them of their fundamental rights for none of their faults.
It is also claimed that the investigation officer and the complainant are the same and it is a settled principle that the complainant himself cannot investigate the case which is biased.
As per the petitioner a notification was issued by the state government on January 21, 2021 calling for recruitment of 545 vacancies for the post of PSI across the state. There appeared to be certain malpractices at the time of examinations held on October 3, 2021 and there was a FIR registered under sections 465, 468, 471, 420, 120 (b) of the Indian Penal Code and further investigation is being carried out by CID.
It is alleged that the complainant Narasimhamurthi who is also the investigating officer issued notices to 172 applicants calling upon them to appear for investigations. Following which 22 candidates were taken into custody, since they were unable to give proper explanation towards their mismatch between OMR sheet and the carbon copy.
It is said that Rachana is a BE Graduate who has appeared in several competitive exams. She has secured the highest marks and obtained 1 rank, while Jagruth has secured 4th rank. However, the FIR and investigation falsely fixing and projecting the petitioner as accused of the alleged offences is highly illegal and opposed to all canons of law. Further it is said the examination hall was surrounded by CCTV cameras and there was absolutely no such possibility of malpractice.
Thus, by way of interim relief the petitioners have sought a direction to stay all further proceedings and investigation in the crime. The plea was heard before a vacation bench of the High Court on Thursday which has now posted the matter for further hearing on May 19.
