The Karnataka High Court on Tuesday refused to hear a matter seeking postponement of Board exams for 5 and 8th standard students of the State board, which is scheduled to be held on March 27.
Advocate A Velan mentioned the matter before a bench led by Chief Justice Prasanna B Varale seeking urgent hearing. It was submitted that the Apex court is seized of the matter challenging the interim order of the Division bench staying the single bench order quashing circulars issued by the government to hold the exams. However, the Apex court has agreed to hear the case on next Monday (March 27).
The bench said “How can you mention the matter, when the Supreme Court is seized of the matter. Otherwise also I was not part of the bench which passed the order. You will have to move the registry.”
In reply it was said “This is not on merits but only to defer the examinations.” The bench then observed “If the Apex court is hearing the matter make your submissions before the apex court.”
It refused to entertain the matter saying “Please don't mention the matter, this will not be taken in good taste.”
In the Supreme Court the petition has been moved by the associations of unaided private schools against the order passed by the division bench of the Karnataka High Court on March 15. The bench had allowed the holding of the board exams by staying an order of the single judge bench which quashed the State Government circulars prescribing the board exams for Class 5 and Class 8.
