The Jharkhand High Court has temporarily suspended the operation of the Note appended to Rule 48(3) of the High Court of Jharkhand Rules, 2001.

Rule 48(3) prescribes that the Affidavits that are filed along with petitions/ applications have to be sworn before the Commissioner of Affidavits or other officer appointed for the purpose.

The note appended thereof further states that affidavits sworn before a notary is "not an affirmation before an officer appointed by the High Court," and thus, the High Court will not entertain the same.


This note has been suspended for a period of three months, thereby permitting affidavits to be sworn in before the notaries.

The notification issued to this effect reads, "The Court has been pleased to suspend the 'Note' of Rule 48 (3) of the High Court of Jharkhand Rules, 2001 for three months."

The move is certainly aimed at easing the process of filings, especially in urgent matters amid the lockdown situation.
