The Delhi High Court on Tuesday adjourned till April 29 the hearing of the petitions filed by students of Jamia Milia University for judicial inquiry on alleged instances of police brutality in the campus in the wake of anti-CAA protests.
Solicitor General Tushar Mehta, appearing for Central Government, told a bench comprising Chief Justice D N Patel and Justice Hari Shanker that the investigation is currently at a very crucial stage.
He submitted that it is due to the nature of the ongoing investigation, that the reply could not be filed by the state. He said:
'Let the investigation continue, the present matter no longer has that urgency.'
Appearing for the students, Senior Advocate Colin Gonsalves informed the court that around 93 students have filed complaints highlighting the police brutality.
'Their plight has also been recorded in the CCTV cameras'.
He further argued that while the police has lodged multiple FIRs against the students, no FIR has been lodged recording the complaints filed by the students.
At this point, SG Tushar Mehta suggested that instead of having multiple FIRs, a single composite FIR can be lodged on behalf of all the complaining students.
Senior Advocate Indira Jaising, who was also appearing for the Petitioners, argued that the state must be directed to file a counter-affidavit within a period of 4 weeks.
'If they want more time, let it come on an affidavit', she submitted.
Students of Jamila Millia Islamia University have been protesting since December 15 against the enactment of the Citizenship Amendment Act. As per the Chief Proctor of the University, Delhi Police forcefully entered the varsity's campus on Sunday, following which, many students were beaten and forced to leave the campus.
In the last hearing on December 19, the Court had denied interim protection to students from any possible coercive action against them in the cases registered against them, and had adjourned the hearing till February 4.
