Inter Religious Marriage: SC Asks Boy To File Affidavit Indicating His Bonafides [Read Order]

A Hindu girl had fallen in love with a Muslim man, who later converted to Hindu religion. They got married to each other in February 2018 and registered their marriage a month later. The parents of the girl were not happy with this marriage.

Although she left her home to join her husband, she was forcibly brought back. This led to her husband filing a habeas corpus petition in the High Court in July 2018 for her release. In this petition, the Chhattisgarh High Court directed the psychiatric examination of a woman who had married a man against the wishes of her parents. This order was later stayed by the Apex Court in the SLP filed by the Girl.

Thereafter the High Court allowed the couple to live together.

Against this order of the High Court, the girl's father approached the Apex Court contending that the marriage a sham and the result of a racket. It was urged that there was a racket being operated in the name of inter-faith marriages and that the Supreme Court should look into it.

"We aren't averse to interfaith marriages. Hindu-Muslim marriages are also acceptable. If they marry each other under the law, why should there be problems? It is also good if caste distinction is done away with. People in so-called high caste and low caste should marry each other. That is even better. They are good for socialism."" remarked a bench comprising Justices Arun Mishra and MR Shah. [Source: News18]

We only want to protect the interests of the couple and be sure about their bonafide. We do get concerned about the future of the women especially and that is why we want to make our efforts to secure her future," said the bench while directing the boy to file an affidavit in this regard.  

The case is now posted on 24th September 2019 for further consideration.
