The Gujarat High Court has fixed days for hearing matters pertaining to Income Tax, GST and Indirect Tax.
The decision has been taken by Justice J B Pardiwala and Justice A C Rao.
In a notice issued this month, the advocates were informed that from now on wards, on every Monday and Tuesday, the court will take up matters pertaining to Income Tax only.
Every Wednesday, it will take up matters pertaining to GST only whereas every Thursday, matters pertaining to indirect taxes only will be taken up for hearing.
In Friday, income tax matters listed for the final hearing will be taken up.
The cut-off matters will be notified in the usual course.
The advocates have been asked not to request for priority in any matter.
The move has not come as a welcome change with all advocates handling tax and GST matters.
The Advocate told Livelaw, "The move with the change in roster has a flipside. With just one day dedicated for GST matters and there being no second appellate forum in place, we have to come to high court in appeal.
"To have just one day for GST matters is also a curtailment of the right to appeal."
That is not all, With the Supreme Court recently clarifying that defaulters under GST cannot seek anticipatory bail, the high court in a state like Gujarat fixing one day is a cause of worry, he adds.
