The full bench of the Gauhati High Court on Friday vacated its interim order dated May 10, 2021 applicable for all subordinate Courts, Tribunals and others due to the improvement in the Covid-19 situation in Assam. The Court vide order dated May 10 had extended the interim orders passed by it, its outlying Benches and other subordinate Courts and Tribunals till June 1, 2021. 

Full Bench comprising of Chief Justice Sudhanshu Dhulia, Justices N. Kotiswar Singh and Manash Ranjan Pathak was dealing with the suo moto PIL instituted by the Court owing to the daily surge of cases during the COVID-19 pandemic.

"Having heard the learned Advocate Generals and considering that the situation in Assam has improved as regarding COVID-19 pandemic, we are of the view that the interim order passed by us on 10.05.2021 needs to be vacated for all the subordinate Courts, Tribunals etc, for which it was operating. As far as the High Court is concerned, for the Principal Bench at Guwahati, we have already vacated this order though effectively from 23.08.2021, the Court observed. 

The Court further clarified that the interim order dated May 10 shall be vacated on August 31, subject to any further orders of the Court in the instant PIL. Leave was also granted to all concerned litigants to move until August 31 appropriate applications for extension of the stay orders or for any other purpose before the Court. 

The Court will now hear the matter on September 1 for further consideration.
