The Gauhati High Court recently granted anticipatory bail to an Assam based professor, accused of promoting Islamic system of education and making derogatory remarks against State's Education Minister as well as the Chief Minister.

Jamir Ahmed Choudhary, working as an Associate Professor with SS College booked under Sections 166 (Public servant disobeying law), 153(A) (Promoting enmity between different groups on grounds of religion, etc.), 153(B) (Imputations, assertions prejudicial to national-integration), 120(B) (Criminal conspiracy) and 505 (Statements conducing to public mischief) of IPC.

It is alleged that he addressed CM Himanta Biswa Sarma as a 'devil and barking dog' and the Education Minister as 'nonsense'.

He is also accused of pushing for 'PIL education', which is primarily based on Islamic faith and value.

He has thus been accused of challenging and demeaning the lawful authority of the State and outraging "religious feeling and an attempt to insult other religious faith with a purpose of creating divisive atmosphere which may create serious law and order situation provoking communal clashes and violence among general public" (sic).

In June, the High Court had granted him interim pre-arrest bail on his executing a bond of Rs. 20,000/-. Choudhary urged that the relief may be made absolute in light of the fact that he has been cooperating with the investigating agency and his statement has been recorded by the IO.

Finding merit in this submission, a single bench of Justice Robin Phukan made the order of pre-arrest bail absolute.
