The Bar Council of Delhi's Disciplinary Committee has taken strict action against an advocate, suspending his license to practice for a period of seven years. The order comes after an exhaustive investigation into serious allegations of professional misconduct, including the forging of court decrees, misleading clients, and contributing to an ex-parte decree of eviction against a complainant's husband.
The case, filed by complainant, accused the advocate of fabricating court documents related to a civil suit filed in 2009. The complainant alleged that the advocate handed over forged decrees and misled her and her late husband about legal proceedings. It was further alleged that the advocate demanded money for initiating a mutation process, causing inordinate delays, and providing false assurances.
Despite being given multiple opportunities to present his defense, the Advocate consistently failed to appear before the Full House of the Bar Council of Delhi and the Disciplinary Committee. The committee, noting the gravity of the allegations and the deliberate absence of the advocate, proceeded ex-parte against him.
The committe, vide order, issued on 18.01.2024, also directed the lawyer to pay a compensation of Rs.2,00,000/- (Rupees Two Lacs Only) to the complainant for the damages suffered due to the advocate's actions. The committee emphasized the importance of protecting the credibility and reputation of the legal profession.
Committee members stated that such stringent actions against legal professionals accused of misconduct are essential to preserving public trust in the justice system. And that the case serves as a reminder that the legal profession is a noble one, and any breach of trust or fraudulent conduct will be dealt with severely.
The Disciplinary Committee's decision aims to send a clear message that professional misconduct will not be tolerated, and legal practitioners are expected to uphold the highest ethical standards in the course of their duties.
