The Kerala High Court recently stayed an order passed by the Additional Chief Judicial Magistrate Court, Ernakulam for release of various curios recovered from infamous fake antiques dealer Monson Mavunkal.
The counsels representing Mavunkal before the bench of Justice Ziyad Rahman A.A. argued that even though he was a party to the proceedings before the Additional CJM, no notice had been served on him, and that the order had been passed by the Court below under Section 451 of Cr.P.C. without hearing him. The petitioner was represented by Advocates M.G. Sreejith, Vidyajith M., P. Jaya, and Luke J. Chirayil.
Mavunkal had hit headlines after his antique collection scam was busted by the Crime Branch pursuant to a complaint of cheating being filed against him. Mavunkal is allegedly involved in various crimes, including three cases of rape.
The Court in the order dated September 23 noted that Mavunkal's application before the Court below seeking release of articles was also pending.
It said there shall be an interim stay on the release of the articles in favour of the respondent, "unless the same had not been already released" in favour of the Detective Inspector, who is the 2nd respondent in the case
"This order shall be in force for a period of one month," said the bench.
