The Delhi High Court directed a District & Sessions Judge to fill the vacancies in its court pertaining to the posts of Senior Judicial Assistants and Judicial Assistants by way of promotion and that of Junior Judicial Assistants that shall fall vacant owing to promotions to the above posts by way of a recruitment drive, as expeditiously as possible. Reiterating the observations made by a Coordinate Bench in an order dated 21 March 2018 regarding the same issue, it stated that

"Every endeavour shall be made by the learned District & Sessions Judge, to fill up the vacant posts, as expeditiously as possible."

The order was passed in a petition filed by the District and Sessions Courts Employees Welfare Association for recruitment to the above mentioned posts that have been lying vacant for over two years since an order passed by a coordinate Bench of the Court to fill these vacancies in March, 2018.

Mr. Rajat Aneja, counsel for the Petitioner Association informed the Court that no steps have been taken towards promotions in the post of Judicial Assistants and Senior Judicial Assistants in the District Court. He also brought the attention of the Court to a Representation made by the Petitioner to the District and Sessions Judge on 07 August 2020.

Mrs. Avnish Ahlawat, counsel for the Respondents informed the Court that the process of appointment/recruitment in the posts of Junior Judicial Assistants, Senior Personal Assistants, Personal Assistants, Data Entry Operator and Group 'C' Employees has already been initiated and is underway.

The Bench comprising Justice Jyoti Singh directed the District & Sessions Judge to dispose of the Representation dated 07.08.2020 made by the Petitioner Association, as expeditiously as possible and not later than four weeks from the date of the order. It also directed them to communicate the Petitioner Association of its decision on the Representation and clarified that the Association shall be at liberty to resort to remedies available in the law if any grievance survives after that.
