The Allahabad High Court on Wednesday (May 26) ordered to extend and provide necessary protection to the life and limb of a Muslim woman who converted to the Hindu religion and married a Man according to Hindu rites.
The Bench of Justice J. J. Munir also directed the Senior Superintendent of Police, Meerut to ensure that the local Police do not interfere in the peaceful married life of the petitioners (Woman and her Husband).
The matter before the Court
A young woman (19 years old) named Yati (original name Kahkasha) married a man, also a major, according to her free will. She submitted that she is Muslim by birth but has great faith in the Hindu religion and she adopted the Hindu religion.
She also submitted that she moved an application before the District Magistrate, Meerut on April 15, 2021 and got the necessary news items published in a newspaper regarding the change of her name and religion.
It was urged that she got married according to Hindu rites on April 16, 2021, at the Arya Samaj Mandir and applied for registration of her marriage before the Registrar of Marriages, Meerut on April 16, 2021. However, her marriage has not been registered till date.
She also submitted that her father is greatly annoyed with the marriage and has threatened the petitioners with death and thus, they moved the local police requesting them to save their life.
Court's order
Noting that a prima facie case was made out, the Court issued a notice returnable on June 23, 2021 (to be served upon Woman's father through the Chief Judicial Magistrate, Meerut)
Until further orders of the Court, the Senior Superintendent of Police, Meerut has been ordered to extend and provide necessary protection to the life and limb of the petitioners and ensure that no harm comes to them at the hands of Woman's father or any member of the first petitioner's family or her native community.
The woman's father was ordered not to enter the petitioners' house, either himself or through his friends, agents, associates, or approach the petitioners through any electronic means of communication, or to cause the petitioners any bodily harm or injury, in any manner whatsoever.
